Acceptance of these terms

By accessing or using the marketing website at siftevidence.com (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site. If you use the Site on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.

These Terms govern the public marketing Site only. The Sift Evidence application, our authenticated product, is provided under a separate agreement, and these Terms do not govern your use of that product.

Informational purpose; not legal advice

The Site provides general information about Sift Evidence and the Perry assistant. Its content is for informational purposes only. It is not legal advice and is not a substitute for professional judgment, and no attorney-client or other professional relationship is created by using the Site. You should not rely on the Site's content as the sole basis for any decision, and you are responsible for independently verifying information before relying on it.

Permitted use and restrictions

You may view and use the Site for lawful, informational purposes. You agree not to:

Intellectual property

The Site and its content, including text, graphics, logos, images, and video, are owned by Sift Labs Corp. or its licensors and are protected by intellectual-property laws. "Sift," "Sift Evidence," and "Perry" are trademarks of Sift Labs Corp. Except for viewing the Site in the ordinary way, no license to use our content or marks is granted.

If you believe content on the Site infringes your intellectual-property rights, please contact us with enough detail to identify the content and your claim, and we will review it.

Feedback

If you send us ideas, suggestions, or other feedback about the Site or Sift Evidence, for example through our contact form, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use that feedback for any purpose, without obligation or compensation to you. Please do not send us confidential information through the Site.

Third-party links and embedded services

The Site links to and embeds third-party services, including our demo scheduler and the application sign-in. We do not control and are not responsible for third-party content, services, or privacy practices. Your use of those services is governed by their own terms.

Product descriptions and forward-looking statements

The Site may describe current or planned features and capabilities of Sift Evidence. These descriptions are for general information, may change without notice, and are not commitments, warranties, or part of any contract. Any purchase of Sift Evidence is governed solely by the separate agreement referenced above.

Export control and sanctions

You represent that you are not located in, and will not use the Site from, any country or region subject to comprehensive U.S. sanctions, and that you are not identified on any U.S. government restricted-party list. You agree to use the Site in compliance with all applicable export-control and sanctions laws.

Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that its content is accurate, complete, or current.

Limitation of liability

To the maximum extent permitted by law, Sift Labs Corp. and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or relating to your use of the Site, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold harmless Sift Labs Corp. from claims, damages, and reasonable expenses arising out of your misuse of the Site or your violation of these Terms. This section applies only to the extent permitted by the law applicable to you (see "Government users").

Suspension and termination

We may suspend or terminate your access to the Site, in whole or in part, at any time, including if we believe you have violated these Terms. Provisions that by their nature should survive termination will survive, including Intellectual property, Feedback, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law and disputes, and General.

Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we handle information collected through the Site.

Government users

If you access or use the Site on behalf of a government entity, some provisions of these Terms, including governing law, venue, indemnification, and limitation of liability, may be limited by the laws, regulations, or constitutional provisions that apply to your entity. In that case, those provisions apply only to the extent permitted by the law applicable to your entity. Nothing in these Terms requires a government entity to act contrary to that law or to waive any protection, including sovereign or governmental immunity, that it cannot lawfully waive.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

Changes to the Site and these terms

We may modify or discontinue the Site, in whole or in part, at any time. We may also update these Terms. The effective date above shows the latest version, and your continued use of the Site after changes take effect means you accept the updated Terms.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and Sift Labs Corp. regarding the Site and supersede any prior understandings. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure caused by events beyond our reasonable control. These Terms create no third-party beneficiaries. Section headings are for convenience only.
